Palm Beach Comic Presser (PBP) provides comic book dry cleaning and pressing services to customers within the United States. Your books must be submitted with a current submission form obtainable from https://PalmBeachPresser.com that includes your contact address, phone number and email, an itemization of all books being submitted, the service level sought, and your signature.
By making a submission you acknowledge and agree to all terms that are listed below.
Risk of damages. You assume all risk of damage that are possible due to the cleaning and pressing process. PRESSING AND CLEANING SERVICES COULD POTENTIALLY CAUSE DAMAGE TO THE COLLECTIBLE INCLUDING, BUT NOT LIMITED TO: SPINE SPLITS, POPPED STAPLES, COVER DETACHMENT, PAPER PIECES CHIPPING OFF, CREASES, INK DAMAGE, TEARS, STAINS AND OTHER DAMAGES. The risk of these damages is higher when books are of lower grade and on older books. Insurance and Palm Beach Presser do not provide coverage for damages that may occur while performing work on collectibles.
Customer Responsibilities.
1. Accurate completion of a Palm Beach Presser submission form.
2. Proper packaging and addressing for shipment. PBP Highly recommends placing comics within a box and then securing that box within an outer box with ample padding or bubble wrap between boxes especially at the corners which are most likely to suffer damage in shipping. You assume all risk of loss or damage that occurs during shipment to PBP or that occurs due to improper packaging or carrier mishandling.
3. Selecting and paying for shipping insurance to PBP if desired. Palm Beach Presser can offer reasonable insurance rates for outbound shipping only.
Payment. Collectibles are to be sent without advance payment. An invoice will be created when the services are completed in accordance with the published rate structure in effect at the time the submission is received.
Some rates are based on the value of the issue at CGC 9.8 regardless of the condition of your copy of the issue. High value issues are based upon FMV (fair market value) of your copy of the book. If you believe any fee charged is in error, we will happily review and adjust if appropriate. If a rate is charged based upon an estimated grade and the book does not obtain the predicted grade, an appropriate adjustment credit will be issued to your account.
Payment is expected within two (2) business days when work is invoiced. Palm Beach Presser will institute a storage fee of $10 if payment is not completed within 15 calendar days and every 15 calendar days thereafter. Invoices that are unpaid after 90 days will be deemed property abandonment and may be sold or disposed of.
Insurance. Palm Beach Comic Presser, Inc has coverage up to certain limits for customer property in their custody for all perils but exclusions which include, but are not limited to, flood, windstorm, hail, terrorism, war, and other standard excluded perils. Palm Beach Presser does not have control of what books are submitted and the corresponding values. Accordingly, at times it is possible that the coverage limits available to PBP may be insufficient to cover all property in the event of a catastrophic loss. In that unlikely event, you agree to accept a pro-rated portion of policy limits available as full compensation. Additionally, you agree to not hold Palm Beach Presser liable for damages that are not covered by the property policy.
Shipping Insurance. Customer is responsible for shipping insurance to PBP if it is wanted. Palm Beach Presser is not responsible for damage or loss in shipping to or from Palm Beach Presser.
Palm Beach Presser has access to reasonable priced outbound shipping insurance. Shipping insurance rates will be posted on the https://PalmBeachPresser.com website and are subject to change periodically. By default, your invoice will include insurance costs based on the estimated value of the shipment. It is the customer’s responsibility to confirm the coverage amount is adequate and adjust the coverage limit accordingly. In order for outbound shipping insurance to be in effect, a coverage limit must be selected and paid for, and a signature will be required on delivery. PBP reserves the right to ship multiple CGC submissions of lower coverage limits together which assists us in providing a lower insurance cost to the customer.
Shipping insurance on outbound shipments valued under $2,500 is optional but electing to not accept it is entirely at your risk. Shipping insurance on packages with values over $2500 is required by Palm Beach Presser for your protection unless you provide an outbound shipping label. If shipment is going to CGC, you may create the shipping label through the CGC ordering process or you may email me a shipping label from your preferred shipper. Providing a label makes you the shipper of record and excuses Palm Beach Presser from any responsibility in a claim process.
In the event of a shipping loss that is insured, PBP will assist with the claim process to the best of our ability but documentation may be required from you to prove the loss and values. The decisions and value evaluations of the Insurance provider, Global Indemnity, are final. Palm Beach Presser is not the insurance carrier or claims adjuster and you agree to hold Palm Beach Presser harmless in the settlement process and amounts. Any failures of the insurance carrier to provide a fair settlement cannot to be held against Palm Beach Presser.
Turnaround Times. Turnaround Times are estimates only and are not guaranteed. If Fast Track orders take more than twice as long as predicted, the Fast Track fees will be waived but not the service fees. Standard Speed turnaround time is difficult to predict with accuracy because it is unknown what quantity of Fast Track orders will arrive before any Standard Speed submission is next in queue. The Standard Speed turnaround time is not guaranteed.
No Guaranteed Results. You acknowledge and accept that pressing and cleaning include inherent risks. Items may contain hidden or pre-existing defects. Some defects may worsen or become more visible. Grade improvement, market value, or acceptance by grading companies is not guaranteed.
Palm Beach Presser will make their best effort to bring each book to its maximum improvement. We DO NOT guarantee that a book is complete, that all defects are identified and reported, and books are free of restoration (we will report identified or suspected restoration but we are not experts at restoration identification).
We do not offer the following services: Restoration or restoration removal, deep or wet cleaning services, de-acidification, whitening, stain removal, or sticker removal in most cases.
Grade Estimates. PBP provides estimated CGC grades when pressing is completed as well as estimated grades for prescreening which attempts to predict what existing defects will be improvable or removable and how the expected changes will ultimately affect a grade. Defects may improve more or less than expected. Accordingly, prescreen grades predictions may be higher or lower than stated so the grades should be utilized only as a guideline.
Final invoice grade estimates are based upon years of experience and review of tens of thousands of graded books. However, due to the subjective nature of grading and the possibility that defects can be overlooked or handling damage can occur at CGC or in shipping, no grade estimate is guaranteed.
Your personal information. We collect information necessary to provide and improve our services, communicate with you, and process transactions. We are committed to protecting your privacy and ensuring the security of your personal data.
We do not sell, rent, trade, or otherwise share your personal information with third parties for their marketing purposes. Your information is only used as necessary to fulfill our services to you or as required by law.
Notwithstanding the above, in the event that the business undergoes a merger, acquisition, restructuring, reorganization, or sale of all or a portion of its assets, the customer database (including your personal information) may be disclosed, transferred, or assigned to the acquiring or successor entity as part of the business assets. By using our services, you acknowledge and agree that such transfers may occur and that any acquirer of our business may continue to use your personal information as set forth in this policy.
Assumption of Inherent Risk. The Customer acknowledges that high-value paper collectibles, comic books, and vintage materials are inherently fragile and susceptible to hidden defects, age-related degradation, and structural stress.
- Pre-Existing Conditions: The Company is not responsible for any pre-existing damage, including but not limited to spine splits, brittle pages, micro-tears, color touches, or restorations that are undetected or become apparent during the provision of services.
- Inherent Risks of Service: The Customer explicitly acknowledges that professional handling, pressing, cleaning, or restoration processes carry inherent risks of accidental structural changes, color shifts, or minor physical alterations. By submitting items, the Customer accepts these risks and waives any claims against Palm Beach Presser for changes inherent or accidentally caused by the processes or handling.
2. Absolute Cap on Liability and Valuation In the event of severe damage, loss, or theft of an item while in the Company’s possession, the Customer agrees that the Company’s total collective liability shall be strictly limited to the lesser of:
- (i) The actual fair market value of the item in its condition prior to the service, as verified by independent third-party pricing guides (e.g., GPA Analysis, Overstreet) or recent comparable sales data; or
- (ii) An absolute maximum liability cap of $500 per individual item, regardless of the item’s perceived, sentimental, or subjective value.
- (iii) The limits of insurance coverage available.
Under no circumstances shall the Company be liable for the potential “graded” value, projected future investment value, or hypothetical loss of profit from a future sale or third-party grading service (such as CGC or PSA) certification score.
Limitation on Return Shipping and Third-Party Transit The Company utilizes third-party shipping carriers (e.g., USPS, FedEx, UPS) to return items to the Customer. The Company’s liability for the safety and condition of any item terminates completely the moment the item is handed over to the carrier. The Company is not liable for items lost, stolen, or damaged in transit. The Customer is solely responsible for requesting and paying for adequate shipping insurance to cover transit risks with coverage options and limitations detailed in “Insurance” section above.
No Waiver of Rights The failure of the Company to exercise or enforce any right, power, or provision of these Terms of Service shall not constitute or be construed as a waiver of such right, power, or provision, now or in the future.
Cumulative Remedies All rights, powers, and remedies granted to the Company under these Terms of Service or by applicable law are cumulative, and the exercise of any single right or remedy by the Company shall not preclude the simultaneous or subsequent exercise of any other rights or remedies available under equity or law.
